General Charter Conditions

The luxury yacht (model of the yacht) is chartered by Plavetnilo d.o.o., ("the Company"). This charter agreement is made between the Company and the individual booking the charter ("you" or "the Client"). The Company agrees to hire the yacht to the Client and not to enter into any other agreement for the charter of the yacht for the same period. The Client agrees to hire the yacht and pay the charter fee and any other agreed charges in cleared funds on or before the dates and to the account agreed between the parties. The schedule shall form part of these terms and conditions.

Should the Client give a notice of cancellation of this agreement he is free to find replacement who will take over all his rights and obligations. If the Client is not able to find the replacement, the Company withholds:
- 20 % of the total amount for the cancellation after booking confirmation
- 30% of the charter fee for cancellation up to 2 months prior to the first day of the charter period
- 70% of the charter fee for cancellation up to 1 month prior to the first day of the charter period
- 100% of the charter fee for cancellation within the last month prior to the first day of the charter period.

Any changes or amendments to bookings received more than two calendar months prior to departure will render you liable to forfeit a 300 Euros administration charge. The Company reserves the right to treat any amendments received within two calendar months prior to departure as a cancellation.

The Company reserves the right to correct errors regarding your holiday arrangements. The Company will contact you as soon as we become aware of the error. If the contract price is higher than the original quote, and you do not wish to pay the additional sum, you will be entitled to cancel, and will receive a full refund of, all moneys paid providing the Company receives written notification within 14 days of it advising you of the error.

The price quoted includes: yacht, yacht equipment, crew (number of guests), final cleaning. Harbor dues, taxes and fuel cost are not included in the price. Fuel is not included in the price. The yacht will be taken over with full fuel tank and the yacht must be returned with full fuel tank.

The maximum number of passengers allowed at sea is (number of guests). The number of persons on board must correspond to the crew list. The Charterer assumes the responsibility for consequences of not compiling with these provisions.

The chartered yachts with complete equipment can be used only after the payment has been completely settled: 50% after the contract had been signed and the remaining 50% 4 (four) weeks before the charter date for bookings made within 6 weeks from the charter date, the Charterer must pay the full amount at once, upon booking.

In the event of severe weather preventing sailing, damage to the yacht or non-availability of the yacht for any reason whatsoever we reserve the right to cancel the charter at any time up to and including the date of the charter. An alternative day will be offered to you. If none is available suitable to both parties the charter fee will be refunded in full as the exclusive remedy to you and you shall have no further claim for any loss or damage whatsoever resulting from the cancellation of the charter.

Neither the Company nor the yacht owner will be liable for any disruption or delay to, or cancellation of the holiday due to hostilities, threat of hostilities, riots, civil commotion, terrorist activities, political unrest, industrial unrest and strikes, natural disasters, closure of airports, change of airline schedules, adverse weather condition or any other circumstances beyond our control.

Passage may be refused to any guest and the charter may be terminated at any time, at the risk and expense of the departing guest, where in the opinion of the yacht's captain, a guest is unfit for travel or a risk or danger to himself or herself, any other guests or the crew. The Company shall not be required to refund any guest/s who must leave prematurely for any of the above reasons or otherwise.

In keeping with the laws of the countries the yacht may be visiting, no firearms, or illegal or controlled substances are permitted to be onboard at any time. Failure to comply will result in the immediate termination of the charter and you will forfeit all monies paid.

Under no circumstances may dangerous articles such as explosives, cylinders containing compressed air or combustible substances etc., be contained in any baggage or brought by any person onboard. The Company reserves the right to refuse to permit any guest to take onboard any items it deems inappropriate.

You agree to be responsible for and to replace and make good any damage to the vessel and any furnishing and all equipment caused by yourself or any or your party. The vessel must be returned in the same condition as it was received, less the ordinary wear and tear. You agree that this vessel will be employed only for the purposes of pleasure and not for any business purposes.

To the fullest extent permitted by law, the yacht owner and his representatives will not be liable for any costs, claims, losses or damage whatsoever to any member of the Client's party whether the taking an active part in sailing the yacht or not.

It is recommended that you obtain appropriate holiday insurance prior to departure. Personal belongings are not covered by the insurance; we recommend the Charterer to do it him/herself in the country of origin. All crew members are covered by the insurance.

Only written complaints, signed by both parties on the occasion of returning the yacht, will be taken into consideration.

This contract is governed by the laws of Croatia and each of the parties submits to the non-exclusive jurisdiction of the Croatian courts in respect of any dispute arising. All possible disagreements or disputes that cannot be settled through negotiation will be settled under the jurisdiction of the Court in Split, Croatia.

These conditions form an integral part of the charter-contract and are certified by the signatures on the charter contract.
